Terms of Service HeyFeels

1. Service Not Intended For Emergencies
This Service is not appropriate for emergency or urgent care. If you have a medical emergency, seek in-person care or dial 911. The Service may not be suitable for all medical conditions.
2. Agreement to Terms
By clicking "I Agree," checking a box, or otherwise accepting, you confirm that you have read and agree to these Terms and Conditions ("Agreement"). Do not use the Service if you disagree. If acting on behalf of another, you confirm you have the authority to accept on their behalf.
3. Arbitration Notice
Unless you opt out, you agree that disputes will be resolved by binding individual arbitration. This means you waive rights to a jury trial or class action. Procedures for opting out are outlined below.
4. About HeyFeels and the Service
HeyFeels, LLC ("HeyFeels," "we," "us") owns and operates www.heyfeels.com (the "Website"). These Terms govern your use of the Website, content, products, services, and affiliated platforms (the "Service").
5. Acceptance of Terms
By using the Service, you agree to abide by this Agreement and applicable laws. We may update these Terms at any time, effective upon posting. Continued use of the Service indicates your acceptance of the revised Terms.
6. Relationship with Providers
We provide access to third-party providers, pharmacies, and Berluga Health (the "Medical Group"). You may form a provider-patient relationship with these entities, not with HeyFeels. HeyFeels does not practice medicine.
7. Consent to Telehealth
Use of the Service includes telehealth services. You must agree to a Telehealth Consent to receive care. Providers and pharmacies are third-party beneficiaries of that consent.
8. Subscription Products
Some products/services are sold via subscription. Your payment method will be charged automatically unless you cancel 3 days before the renewal date. No refunds for partial periods. Cancellation must be done via email or account dashboard.
9. Prescription Products
Prescription items require a valid consultation. Fulfillment is handled by our partner pharmacies. If you use a non-partner pharmacy, you are responsible for pickup and payment.
10. Financial Responsibility
HeyFeels and partners are not part of federal/state programs (e.g., Medicare). You agree to receive services on a self-pay basis and not to seek reimbursement from such programs.
11. Use and Availability
You must be 18+ (or 13+ with guardian consent) and located in a service-eligible state. Service is not available in: Alaska, Arkansas, Louisiana, New Hampshire, Oregon, South Carolina, West Virginia, and DC.
12. Technical Requirements
You must provide your own hardware and internet. It is your responsibility to ensure accurate, current, and complete information and system compatibility.
13. Privacy and Health Information
Personal and health information is governed by our Privacy Policy and relevant laws. HeyFeels is not a HIPAA-covered entity, but affiliated providers may be.
14. Ownership and License
The Service and content are protected by copyright. You are granted a limited license for personal use. All rights not explicitly granted are reserved by HeyFeels.
15. Submissions
You grant HeyFeels a license to use your submissions (e.g., comments, feedback) unless otherwise restricted by law. Protected health information is excluded from this license.
16. Prohibited Uses
You may not:
- Use the Service for unlawful, harmful, or unauthorized purposes
- Interfere with others' use of the Service
- Reverse engineer, hack, or data mine the Service
- Transmit spam, malware, or inappropriate content
Violation may result in suspension or legal action.
17. Account Management
You are responsible for maintaining your account credentials and updating your information. Notify us of any unauthorized use. You may not share accounts.
18. Third-Party Services and Indemnification
We partner with third parties to provide services/products. We are not responsible for issues arising from those interactions. You agree to indemnify HeyFeels and partners against related claims or disputes.
19. Right to Monitor
We reserve the right to monitor and remove content that violates these Terms or applicable laws.
20. Terms of Sale
All purchases are subject to availability and may be rejected or modified. You are responsible for applicable taxes. We may correct pricing errors or cancel orders accordingly.
